These Service Conditions govern your access to and use of the Assistaffer platform. By creating an account, joining an organization, or otherwise using Assistaffer, you agree to be bound by these terms. Please read them carefully before using the service.
1. Who We Are
Assistaffer is a multitenant appointment scheduling platform for service-based organizations. We provide tools for businesses to manage resources, staff access, and customer appointments through a web dashboard and WhatsApp-based AI agent.
References to "Assistaffer", "we", "us", or "our" in these conditions refer to the operator of the Assistaffer platform. References to "you" refer to any person who accesses or uses the platform, whether as a registered user, an organization owner, a staff member, or a customer interacting through a messaging channel.
2. Acceptance of Terms
By registering for an Assistaffer account, creating or joining an organization, or using any feature of the platform, you confirm that:
- You have read and understood these Service Conditions.
- You are at least 16 years of age or the age of digital majority in your jurisdiction.
- You have the authority to enter into a binding agreement on behalf of any organization you represent.
- Your use of the platform complies with applicable laws and regulations in your jurisdiction.
If you do not agree to these conditions, you must not use the Assistaffer platform.
3. Your Account
3.1 Registration
To access the platform's management features, you must register with a valid email address and create a password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Account Security
You must notify us immediately if you become aware of any unauthorized use of your account or any security breach. Assistaffer is not liable for losses arising from unauthorized access to your account that results from your failure to keep your credentials secure.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep that information up to date. Providing false or misleading information is grounds for immediate account suspension or termination.
4. Organizations and Memberships
The Assistaffer platform is structured around organizations. Each organization is a distinct tenant with its own resources, schedules, customers, and appointments. The following conditions apply to organizations and their members:
- The user who creates an organization becomes its owner and is responsible for its configuration and the conduct of all members.
- Organization owners may invite users to join as managers or staff members and may remove members at any time.
- Each member's access is governed by their assigned role (owner, manager, or staff) as defined in the platform.
- An organization's data is scoped exclusively to that organization and is not accessible by members of other organizations.
- Organization owners are responsible for ensuring that their use of the platform and any connected third-party services (such as WhatsApp Business or AI model providers) complies with the terms of those services.
5. Acceptable Use
You agree to use Assistaffer only for lawful purposes and in accordance with these Service Conditions. You must not use the platform to:
- Violate any applicable local, national, or international law or regulation.
- Send unsolicited communications, spam, or any messaging that violates applicable messaging or anti-spam laws.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Transmit or store any data that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorized access to any portion of the platform, its infrastructure, or other users' data.
- Interfere with or disrupt the integrity or performance of the platform or its underlying systems.
- Use automated scripts, bots, or other means to access or scrape the platform beyond its intended functionality.
- Collect or harvest personal data of other users or customers without appropriate authorization.
We reserve the right to investigate and take appropriate action against any violation of this section, including suspending or terminating the offending account without notice.
6. Customer Data and Messaging
When you configure an organization to use WhatsApp messaging, you are responsible for:
- Obtaining all necessary consents from customers before sending them messages through WhatsApp or any other channel.
- Complying with the WhatsApp Business Policy and Meta's terms of service for your WhatsApp Business account.
- Ensuring that AI-generated responses sent to customers through your configured AI agent are appropriate, accurate, and compliant with applicable consumer protection laws.
- Maintaining appropriate records and responding to customer requests regarding their personal data in accordance with applicable privacy regulations.
Assistaffer acts as a data processor on behalf of your organization for customer data you collect and store through the platform. You remain the data controller and are responsible for lawful processing of that data.
7. Intellectual Property
7.1 Platform Ownership
The Assistaffer platform, including its software, design, trademarks, logos, and content created by us, is owned by Assistaffer and is protected by applicable intellectual property laws. Nothing in these Service Conditions grants you any right to use our trademarks, trade names, or brand features without prior written consent.
7.2 Your Content
You retain ownership of all content you upload or create within the platform, including organization names, system prompts, customer records, and appointment data. By using the platform, you grant Assistaffer a limited, non-exclusive licence to store, process, and transmit that content solely to provide and operate the service.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the platform, you grant Assistaffer the right to use that feedback freely and without obligation to you.
8. Third-Party Services
Assistaffer integrates with third-party services including Supabase (database and authentication), Meta WhatsApp Cloud API (messaging), and your organization's configured AI language model provider. Your use of features that depend on these services is also subject to the terms and policies of those third parties. Assistaffer is not responsible for the availability, accuracy, or conduct of any third-party service.
9. Disclaimers
The Assistaffer platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The platform will be uninterrupted, error-free, or free from harmful components.
- AI-generated responses produced by your configured language model will be accurate, complete, or appropriate for any particular purpose.
- The platform will meet your specific business requirements.
Use of the AI booking agent is at your own risk. You are responsible for reviewing and validating AI-generated content before relying on it for business decisions.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Assistaffer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the platform.
In no event shall Assistaffer's total cumulative liability to you for any claims arising under or related to these Service Conditions exceed the greater of (a) the amount you paid to Assistaffer in the twelve months preceding the claim, or (b) one hundred euros (€100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.
11. Termination
11.1 By You
You may stop using the platform at any time. Organization owners may delete their organization and associated data from within the platform settings. Account deletion removes your personal data from our active systems, subject to our data retention policy as described in our Privacy Policy.
11.2 By Assistaffer
We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have violated these Service Conditions, applicable law, or the rights of any third party. We may also discontinue the platform or any feature at any time with reasonable notice where practicable.
11.3 Effect of Termination
Upon termination, your right to use the platform ceases immediately. Sections of these conditions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
12. Changes to These Conditions
We may update these Service Conditions from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review these conditions periodically. Continued use of the platform after changes are posted constitutes your acceptance of the updated conditions.
13. Governing Law
These Service Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Assistaffer operates, without regard to its conflict of law provisions. Any disputes arising under these conditions shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
